Warranty on used devices: what it covers and what your rights are
A commercial warranty and statutory liability are not the same thing. The difference matters.
Two different protections
· A commercial warranty — the seller's voluntary promise: its term, scope and conditions are whatever they wrote.
· Statutory liability for conformity — a trader's obligation under law. It does not disappear because the goods are used, and it cannot be removed by a line in the listing.
What is usually NOT covered
· Liquids and signs of moisture.
· A broken screen and physical impacts.
· Opening or repair at an unauthorised service.
· Normal battery wear.
· Software problems after user intervention (jailbreak, root).
What to ask for in writing
The term, exactly what is covered, where the repair takes place and within what period. A verbal warranty is hard to prove.
Private seller versus trader
When buying from a private individual, a trader's statutory liability does not apply — the contract is between two citizens. That is why inspection before payment matters even more in a private deal.
